Why Now

What’s normal now

Today, health brands sell prescription products through real people — doctors, nurses, patients — and that has become completely normal.

A brief goes out, someone posts, an invoice gets paid. The same way a brand would buy a photo or a t-shirt design.

Nothing in that process treats it as a regulated transaction.

The problem

  1. When a regulator or a lawyer asks what was agreed to, the answer sits in legal’s files, a review queue, a DM, and a post that may be gone.
  2. The endorser carries real exposure without much record of what she was told she could say.
  3. Insurers struggle to price this kind of risk, so brands tend to carry it themselves.

Our approach

We don’t think better filing fixes this. The facts have to be captured where the deal is agreed to and paid for, so there’s nothing to assemble later.

Disclosure Facts makes one record of the endorsement as it happens, held by everyone in it.

Never buy or sell a drug endorsement without Disclosure Facts.

The stakes are rising.
