Disclosure Facts is owned and operated by Swaypay It, Inc. We are the data controller for information collected through our Services. We provide tools such as Universal Clickable Disclosures (UCD), Disclosure Facts Profiles (DFP), and the Disclosure Integrity Protocol (DIP) to make creator advertising disclosures clear, consistent, and accessible. We are not a law firm and do not provide legal advice.

2) Information We Collect

We collect the following types of information:

a) Information you provide

Account setup. When you create an account, we may collect your name, email address, display photo (optional), organization/brand information, and settings relevant to your role (e.g., brand, creator, agency).

Profile information. If you complete a Disclosure Facts Profile, you may provide company or creator details, links to posts, role/compensation selections, and other disclosures.

Communications. If you contact us, we may collect your name, email, and the content of your message.

b) Information collected automatically

Device and log data. IP address, browser type/version, device identifiers, operating system, pages viewed, time/date stamps, and referring URLs.

Usage data. Interactions with the Services (e.g., label creation, toggles selected, profile edits, link clicks).

Location data. Approximate location (from IP or device settings) to improve service functionality and display regionally relevant content. You can disable location sharing in your device or browser settings.

c) Information from third parties

If you connect a third‑party service (e.g., a social media platform or ad manager), we may receive information consistent with your settings on that service.

3) How We Use Information

We use your information to:

  • Provide and operate the Services (e.g., generate UCDs, host DFPs, maintain DIP logs);

  • Improve, personalize, and secure the Services;

  • Communicate with you (e.g., service updates, account notices, marketing where permitted by law);

  • Enforce our Terms of Use and comply with legal/regulatory obligations.

  • Legal bases for processing include: (a) performance of a contract (Terms of Use), (b) our legitimate interests (e.g., improving Services, security), and (c) compliance with law.

  • Affiliates and service providers who help us operate, maintain, and improve the Services;

  • Brands/Creators you connect with through the Services (per your settings);
